Terms and Conditions of Use
Please read these Terms and Conditions of Use ("Terms") carefully before accessing or using VideoEditor's website, browser extension, mobile applications, APIs, or any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
In these Terms, "VideoEditor," "we," "us," or "our" refers to BIGMDATA INTERNATIONAL PTE. LTD. VideoEditor Inc Sub. "You" or "your" refers to any individual or entity using the Services.
1. Acceptance of Terms
By using VideoEditor, you agree to comply with these Terms and all applicable local, national, and international laws and regulations. The content, software, and materials available through the Services are protected by copyright, trademark, and other intellectual property laws.
2. Description of Services
VideoEditor provides AI-powered video editing and repurposing tools, including but not limited to automatic highlight detection, video clipping, caption generation, subtitle editing, auto-reframing, silence removal, B-roll insertion, and export optimization for social media platforms such as TikTok, YouTube Shorts, and Instagram Reels.
We may update, expand, or limit the features available through the Services at any time without prior notice. We do not guarantee that any particular feature will always be available.
3. User Accounts and Content
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You retain ownership of the videos, audio, images, text prompts, and other materials you upload ("User Content").
By uploading User Content, you grant VideoEditor a limited, non-exclusive license to process it solely for the purpose of providing the Services to you. We do not use your User Content to train, improve, or develop our AI models without your explicit consent.
You represent and warrant that you have all necessary rights to upload and use your User Content, and that it does not infringe any third-party intellectual property rights, privacy rights, or applicable laws.
4. Refund Policy
All VideoEditor subscriptions and digital services are non-tangible and delivered immediately upon payment. As a result, we generally do not issue refunds once an order is completed.
We recommend reviewing our features and trying the service before purchasing. Refunds may be considered in limited circumstances, such as:
- A confirmed system error caused by VideoEditor that prevents service delivery.
- A request made within 24 hours of the first payment, provided no more than 10% of allocated credits have been used.
- A request made within 72 hours of the first payment, provided no more than 5% of allocated credits have been used.
- Refunds are not available after 72 hours. Processing may take 7-15 business days.
Renewal, plan upgrades, and repurchases are not eligible for refund under this policy. The first payment means the initial payment with an identified account. Please provide thorough and supported reasons when requesting a refund. We do not guarantee refunds for lack of usage or general dissatisfaction.
5. Subscription and Billing
Your subscription begins when payment is processed and automatically renews at the end of each billing period unless canceled. You authorize VideoEditor to store your payment method and charge it automatically each period until cancellation.
You may cancel at any time through your account settings (Profile -> My Plan -> Cancel Subscription) or by contacting our support team. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription period.
6. Acceptable Use
You agree not to use the Services in any way that is unlawful, harmful, or violates the rights of others. Specifically, you may not:
- Use the Services for any illegal, harmful, fraudulent, or abusive purpose.
- Upload content that infringes third-party rights, violates applicable laws, or contains malware or harmful code.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Services.
- Use automated scripts, bots, or scraping tools to access or interact with the Services without authorization.
- Resell, redistribute, sublicense, or commercially exploit the Services without our written permission.
- Interfere with or disrupt the integrity, security, or performance of the Services.
7. Intellectual Property
All software, designs, logos, trademarks, user interfaces, documentation, and other materials provided by VideoEditor remain the property of VideoEditor or its licensors. Your use of the Services does not grant you ownership of any intellectual property rights in our platform or outputs, except for the limited rights expressly granted herein.
You retain ownership of your User Content and any original creative elements you contribute. You are responsible for ensuring that your use of the Services and any content you create does not infringe the rights of third parties.
8. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, secure, or meet your specific requirements. AI-generated outputs, including clips, captions, and transcripts, may vary in accuracy and quality and should be reviewed before publication.
9. Limitation of Liability
To the fullest extent permitted by law, VideoEditor and its suppliers, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.
In no event shall our total liability exceed the amount you paid to VideoEditor for the Services during the twelve (12) months preceding the claim. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages, so these limitations may not apply to you.
10. Modifications to Terms
We may update these Terms at any time without prior notice. Continued use of the Services after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically. Material changes will be indicated by updating the "Last updated" date below.
11. Third-Party Links
The Services may contain links to third-party websites, services, or content that are not owned or controlled by VideoEditor. We are not responsible for the content, privacy policies, or practices of any third-party site or service. Your use of any linked website is at your own risk.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VideoEditor operates, without regard to conflict of law principles. Any claim related to the Services shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
